Copyright
Article 42 of the Constitution of the Portuguese Republic lays down the right to freedom of cultural creation and copyright protection. The right of an author over his/her work, including computer programs, covers property and moral rights over it (Articles 9 and 11 of CDADC and 1303 and 48 of CC.
All software and related items are also protected by other provisions of ordinary legislation (Law No.50/2004 dated 24 August and Law No.109/91 dated 17 August) of EU legislation for ICT (EU Guideline No.2001/29/CE of the European Parliament and the Council dated 22 May) and by International Treaties such as OMPI. Software is thus covered by copyright protection and be used in compliance with it.
